FINED FOR HAVING BREAST CANCER - A surreal situation in Portugal

  Cristina Nogueira, a 46-year-old lawyer
is facing one of the worst phases of her life. 
Between chemo and radiotherapy sessions, 
surgeries and consultations -
fighting breast cancer that has progressed to her brain 
- she now faces more than 20 cases of misconduct 
that have been brought against her, 
by the Commission for the Follow-up of Justice Assistants. (CAAJ).

This is because Cristina, is no longer able to fulfill her responsibilities,
 as a judicial administrator in dozens of insolvency proceedings,
 against people and companies in court.

As the newspaper "Expresso" puts it, 
the CAAJ has notifying her to voluntarily pay 
a fine of € 5,000 for each of these insolvency proceedings, 
which was dismissed,
 while she was struggling with the aggressive cancer.

"This CAAJ process is surreal. 
It is one thing to be punished for diverting money 
or for doing wrongful acts. 
Another thing is to be punished for causing some delay 
in the progress of cases due to serious health issues. 
It's not a flu, it's cancer", 
Cristina Nogueira told the newspaper.

She argued, that so far, 
no debtor or creditor ever complained of her - 
"Not one" - and that the courts that dispensed her services,
were even sensitive to her situation, 
having continued to rely on her work 
and to appoint her to new cases.

Divorced and with a minor child in her charge, 
with the morgage of her house to pay, 
 without parents or an inheritance to help her, 
this mother even brought the office home 
during the most aggressive phase of the treatments, 
to be able to comply "with was humanly possible", 
with "the most urgent cases" 
in the various insolvency proceedings 
that she had accompanied as a judicial administrator. 
Now she risks losing her home, 
her professional name and her job.
