Late Friday evening,
the constitutional court ruled against 4 important issues
of the current government's austerity budget.
Now the government has to find more than 1,3 billion euros
to compensate for the loss of these emergency measures,
jeopardizing Portugal's external commitments
in repaying its enormous debt.
For starters, this ruling,
violates the principle of separation of powers.
The judges who approved the document,
invaded areas that are the exclusive responsibility
of the government and parliament.
The TC can not suggest "alternatives" that are,
inevitably,
an increase of tax revenue.
If they wanted to propose tax increases or renegotiations
conditions with the troika,
the judges will just have one way forward,
within the constitutional framework of a parliamentary democracy
based on the sacred principle of separation of powers, namely:
discarding their judge's toga,
leaving the comfortable position of a constitutional judge
and stand for democratic parliamentary election.
An obvious question is:

An obvious question is:
Does this court have constitutional jurisprudence in a
financial
emergency ?
No. It is a matter for the parliament and government
to solve and decide upon,
by deputies and ministers elected to define
and implement governmental policies.
The group of constitutional judges who ruled against
part of the austerity budget of the Portuguese government,
assume the role of an alternative government,
a government of vigilantes,
a shadow government
who controls a democratically elected government.
who controls a democratically elected government.
Part of these judges' "aquired rights"
is the fact
is the fact
that after ONLY 10 years of service,
they can retire, with full benefits,
and 14 months of full salary per year.
These judges have ruled in their own selfish interests
without any impartiality or exception.
